Website agreement to terms and conditions of sale

These Terms and conditions, which include our Shipping Policy and Privacy Policy, constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Mia Cooper and Co (“we”, “us”, or “our”). By using our website www.miacooperandco.com.au as well as any other media form, social channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”) you unreservedly accept these Terms and Conditions, including our Shipping Policy and Privacy policy, and you agree that your use of our website, including any purchase of goods from us, is subject to the terms thereof. 

 

Please read these conditions carefully, as they apply to all transactions between us and can only be waived or varied in writing signed by us. By proceeding with a purchase on our Website, you are indicating to us that you have read, understood and agreed to these conditions.

 

We may make amendments to these policies occasionally by updating our website. You should check this website from time to time to ensure that you are happy with any changes. We encourage you to read these Terms and Conditions, and contact us if you have any particular questions. If you do not agree to these Terms and Conditions, you must not use our website in any manner.

 

Products

We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on this site and our media channel/s, however, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. You acknowledge that due to the custom and personalised nature of our ‘from photo’ products, dimensions and product features may vary ever so slightly from the product image and/or description in order for us to create the best possible product from the image provided to us.

 

We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

 

Cancellations or changes

You may cancel your order within 24 hours from placing your order (excluding ‘from photo’ products)

Cancellations, edits or changes to orders from our ‘from photo’ products will incur a $50 fee to compensate for design work already completed on original artwork. Should you wish to cancel, edit or amend an order, or part thereof, please contact us at admin@miacooperandco.com.au.

 

Variation

We can change these conditions at any time by updating this document and giving notice to you by posting a copy on the Website. The changes will take effect immediately upon being posted. 

 

Force Majeure

We shall not be responsible for any delay, suspension or failure to despatch your order arising out of any circumstances outside of our reasonable control. Including but not limited to, acts of God, governmental actions, shipping, postal or other relevant transport strike, postal theft, failure or accident, lockouts or other labour difficulty, war or national emergency, acts of terrorism, fire, explosion, flood, an act or omission of a third party, inability to obtain any necessary materials, equipment, facilities or services, injury or illness to key personnel, the failure of performance provided by others, interruption of the internet or a website (such as Facebook) or virus, accidents or breakdown of plant, machinery, software, hardware or communication network. If circumstances we cannot control affect our ability to dispatch your order, you release us from any obligation to dispatch your order while those circumstances continue.  While they continue, we may choose to cancel your order, or otherwise to complete your order once things have returned to normal. If we expect a major delay, we’ll contact you to discuss a suitable solution.

Severability

If any provision in these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, that section will be severed, and the rest of the agreement will remain and continue in full force and effect.

 

Termination

We may terminate this agreement at any time on notice to you. All disclaimers and limitations of liability will survive termination. On giving such notice, we will refund any amounts paid by you in respect of undelivered goods.
